STANDARD TERMS AND CONDITIONS OF SALE

(S Creation)

These Terms and Conditions (“Terms”) govern all sales of products (“Goods”) made by S Creation (“Seller”) to any purchaser (“Buyer”). By placing an order with us, the Buyer agrees to be bound by these Terms.

1. Orders & Acceptance

  • All orders are subject to acceptance by the Seller.
  • Once confirmed, orders cannot be cancelled, modified, or withdrawn by the Buyer.

2. Prices & Payment

  • Prices are as quoted at the time of order.
  • Payments must be made in full before dispatch, unless otherwise agreed in writing.

3. Non-Refundable & No Exchange Policy

  • All sales are final.
  • No refunds, replacements, or exchanges will be provided under any circumstances.
  • Buyers are advised to review product details carefully before purchase.

4. Shipping & Delivery

  • Shipping timelines are estimates only and not guaranteed.
  • The Seller is not responsible for delays in transit, including those caused by courier companies, logistics partners, customs, strikes, natural calamities, or unforeseen events.
  • Risk of loss or damage during transit passes to the Buyer once the Goods are handed over to the courier/shipping carrier.

5. Damages During Transit

  • The Seller is not liable for breakage, loss, or damage to Goods once dispatched.
  • Buyers must raise any claims for transit-related issues directly with the courier/shipping company.

6. Limitation of Liability

  • The Seller’s liability is limited strictly to the value of the Goods sold.
  • The Seller shall not be held liable for any indirect, incidental, or consequential losses arising from the purchase, use, or delivery of Goods.

7. Governing Law & Jurisdiction

  • Any disputes shall be subject to the exclusive jurisdiction of the courts at Howrah only.

8. Amendments

  • The Seller reserves the right to amend or update these Terms at any time without prior notice.
